Terms of Service

1. Acceptance of Terms

By accessing and using PicklePro (“Service”, “Platform”), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

These Terms apply to all users of the Service, including club owners, administrators, coaches, and players who book courts or sessions through the Platform.

2. Description of Service

PicklePro is a comprehensive pickleball club management and booking platform that enables:

  • Club owners to manage facilities, courts, coaches, and sessions
  • Players to discover clubs, book courts, schedule lessons, and join group sessions
  • Payment processing for bookings, memberships, and subscriptions
  • Communication between clubs and their members

3. User Accounts and Registration

Club Owner Accounts: To list your club on PicklePro, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Player Accounts: Players must register to book courts, schedule lessons, or join sessions. You agree to provide accurate personal information and update it as necessary.

You must be at least 13 years old to use this Service. Users under 18 must have parental or guardian consent.

4. Payment Terms

Payment Processing: All payments are processed through Stripe, our third-party payment processor. By making a payment, you agree to Stripe's terms of service and privacy policy.

Platform Fees: PicklePro charges a service fee on transactions processed through the Platform. Fees are transparently displayed before purchase.

Club Subscriptions: Club owners pay monthly or annual subscription fees for using the Platform. Subscription fees are billed automatically at the beginning of each billing period.

Booking Payments: Players pay for court bookings, lessons, and sessions at the time of reservation. Payments are transferred to club owners after deducting applicable fees.

Currency: All prices are listed in GBP (British Pounds) unless otherwise specified.

5. Subscription Terms

Free Trials: New club subscriptions may include a free trial period. Your payment method will be charged at the end of the trial unless you cancel before the trial ends.

Cancellation: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.

Price Changes: We reserve the right to modify subscription pricing with 30 days' advance notice. Continued use of the Service after price changes constitutes acceptance of the new pricing.

6. Refund Policy

Booking Cancellations: Cancellation policies are set by individual clubs. Generally, cancellations made more than 24-72 hours before the booking time (as specified by the club) are eligible for full refunds. Late cancellations may incur fees or forfeit payment.

Subscription Refunds: Subscription fees are non-refundable except as required by law or at our sole discretion.

Refund Processing: Approved refunds are processed within 5-10 business days to the original payment method.

7. Club Responsibilities

As a club owner using PicklePro, you agree to:

  • Provide accurate information about your facilities, including court availability, amenities, and pricing
  • Honor all bookings made through the Platform
  • Maintain your facilities in safe, playable condition
  • Comply with all applicable local laws and regulations
  • Respond promptly to player inquiries and concerns
  • Not discriminate against players based on protected characteristics
  • Complete Stripe Connect onboarding to receive payments

8. Player Responsibilities

As a player using PicklePro, you agree to:

  • Arrive on time for your bookings and reservations
  • Follow club rules and etiquette
  • Cancel bookings according to the club's cancellation policy
  • Treat club staff, coaches, and other players with respect
  • Pay for all bookings and services in a timely manner
  • Not resell or transfer bookings without club permission

9. Prohibited Uses

You may not use PicklePro to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful or malicious code
  • Harass, abuse, or harm others
  • Impersonate others or misrepresent your affiliation
  • Collect user data without consent
  • Interfere with the proper functioning of the Service
  • Attempt unauthorized access to any part of the Service

10. Intellectual Property

The Service, including all content, features, and functionality, is owned by PicklePro and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Club owners retain ownership of their club information, logos, and content uploaded to the Platform but grant PicklePro a license to use this content to provide the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICKLEPRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

PicklePro is a platform that connects clubs and players. We are not responsible for the quality, safety, or legality of clubs or sessions listed, the ability of players to complete bookings, or the actions of users on the Platform.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to PicklePro in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless PicklePro, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be governed by the laws of England and Wales, without regard to conflict of law principles.

You agree to first attempt to resolve disputes informally by contacting us. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the London Court of International Arbitration, except where prohibited by law.

14. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us. Termination does not relieve you of obligations incurred prior to termination.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Platform. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

16. Entire Agreement

These Terms constitute the entire agreement between you and PicklePro regarding the Service and supersede all prior agreements and understandings.
